E-services for registration of plant varieties and Plant Breeders' Right

This is the e-services for registration of plant varieties in the Swedish National list of varieties and for registration of Swedish Plant Breeders´Right. In the e-service, you will be able to submit six different types of applications.

If you do not have any Swedish identification number and address identification connected to the applicant, agent and preliminary maintainer, please contact us.

Registration of plant varieties

This is the application to register a plant variety in the Swedish National List of Varieties. This applies to agricultural plant varieties, vegetable plant varieties and fruit plant varieties.

The application fee for registration of one agricultural, or vegetable plant variety is 3 000 SEK. There is no application fee for registration of a fruit plant variety. You must pay the application fee by card in the e-service. If you are unable to pay by card you have to fill in the form Registration of plant variety to the Swedish list of varieties.

You may submit the application to register several varieties at the same time.

Information that you must submit in the e-service when you register a plant variety

  • Your identification number, as well as a special address identification for the applicant. If there is an agent or a maintainer, their identification number and address identification must also be registered. If you do not have identification number or an address identification, contact us via e-mail before you apply, vaxtsort@jordbruksverket.se.
  • Overall characteristics for the variety you want to register.
  • Your variety´s proposed variety denomination. It is possible to complete the application form without the variety denomination. You may complete the application later.
  • The preliminary variety identification or the breeder's reference.
  • Name of any trademark and in which country you applied for or registered the trademark.
  • Information on any previous applications either for plant breeders' rights or for registration in a national list of varieties, in Sweden or any other country or to CPVO, the application date, registration date, which country, variety denomination, variety identification or the breeder's reference.
  • Information on official technical examination of the variety's distinctness, uniformity and stability (DUS examination). Attach a DUS report or a preliminary variety description according to the CPVO's or UPOV's technical questionnaire.
  • Possible identification reference for a GMO variety.

If you are an agent of the applicant, you must enclose a letter of attorney.

Registration of conservation varieties or varieties developed for growing under particular conditions

This is the application to register conservation varieties or a varieties developed for growing under particular conditions. The application fee for registration of one variety is 800 SEK. You must pay the application fee by card in the e-service. If you are unable to pay by card you have to fill in the form.

Information that you must submit in the e-service when you register a conservation variety or a variety developed for growing under particular conditions

  • Your identification number, as well as a special address identification for the applicant. If there is an agent or a maintainer, their identification number and address identification also must be registered. If you do not have an identification number or address identification , please contact us via e-mail before you apply, vaxtsort@jordbruksverket.se.
  • If the variety is found in the NordGen, the gene bank or in the National Gene Bank for vegetatively propagated plant material, you should state the accession number. If you do not have an accession number, explain why it is missing.
  • Why the variety is worthy of preservation and its origin.
  • What is specific to the particular variety you want to register and a variety description.
  • The variety denomination for your variety and synonyms.
  • Name of any trademark and in which country you applied for or registered the trademark.
  • Possible identity designation for GMO varieties.
  • Specify from where data for the variety's distinctiveness, uniformity and stability were obtained.

If you are an agent of the applicant, you must enclose a letter of attorney.

Registration of Plant Breeders’ Right

This is the application to register a Swedish Plant Breeders’ Right.

The application fee for registration of one plant variety is 3 000 SEK. You must pay the application fee by card in the e-service. If you are unable to pay by card you have to fill in the form.

Information that you must submit in the e-service when you register a Plant Breeders’ Right

  • Your identification number, as well as a special address identification for the applicant. If there is an agent or a maintainer, their identification number and address identification also must be registered. If you do not have an identification number or address identification, please contact us via e-mail before you apply, vaxtsort@jordbruksverket.se.
  • The preliminary variety identification or the breeder's reference.
  • The proposed variety denomination for your variety. It is possible to complete the application with the variety denomination later.
  • A novelty declaration.
  • Name of any trademark and in which country you applied for or registered the trademark.
  • The original breeder or breeders of the variety. You also has to state how you have gained access to the variety. Attach any documentation confirming transfer.
  • Information on any previous applications either for plant breeders' rights or for registration a national list of varieties, in Sweden or any other country or to CPVO, application date, registration date, which country, variety denomination, variety identification or the breeder's reference.
  • If you request priority, state in which country you submitted the previous application, the date and name of the application. You also has to attach priority documents.
  • If the variety has been sold or otherwise exploited, prior to the date of submission of the application, you must state in which country, when the variety was sold and under what variety denomination.
  • Information on official technical examination of the variety's distinctness, uniformity and stability (DUS examination). Attach a DUS report or a preliminary variety description according to the CPVO's or UPOV's technical questionnaire.
  • Possible identification reference for a GMO variety.

If you are an Agent of the applicant, you must enclose a letter of attorney.

Complete the application with variety denomination

If you have submitted an application to register a plant variety or Plant Breeders’ Right, you may supplement with the variety denomination if it is missing in your previous application.

  • Your identification number, as well as a special address identification for the applicant. If there is an agent or a maintainer, their identification number and address identification also must be registered. If you do not have an identification number or address identification, please contact us via e-mail before you apply, vaxtsort@jordbruksverket.se.

If you are an agent of the applicant, you must enclose a letter of attorney.

Renewal of plant variety registration period

This is the application for renewal of the registration period.

The application fee for renewal of the registration period for one plant variety is 2 000 SEK. The fee will be invoiced.

  • Your identification number, as well as a special address identification for the applicant. If there is an agent or a maintainer, their identification number and address identification also must be registered. If you are an agent of the applicant, you must enclose a letter of attorney.

Withdrawal of an application or registration of plant variety or Plant Breeders’ Right

This is the application for withdrawal of an application or registration of plant variety or Plant Breeders’ Right.

Information that you must submit in the e-service when you apply for withdrawal of an application or registration of plant variety or Plant Breeders’ right

  • Your identification number, as well as a special address identification for the applicant. If there is an agent or a maintainer, their identification number and address identification also must be registered. If you do not have an identification number or address identification, please contact us via e-mail before you apply, vaxtsort@jordbruksverket.se.

If you are going to withdraw an application, please enter

  • area of use (agricultural, vegetable or fruit plant)
  • species name
  • preliminary variety identification or the breeder's reference.

If you are going to withdraw a registered plant variety or a plant breeder's right, you must state

  • area of use (agricultural, vegetable or fruit plant)
  • species name
  • the variety denomination.

If it concerns a variety in the Swedish variety list, you must also state whether the application applies to a market extension for the plant variety.

If you are an agent of the applicant, you must enclose a letter of attorney.

Think about this before you apply

Check that the variety is not already registered or if someone else has applied for registration of the variety. You can do this in the Swedish variety list.

Processing of personal data

The Swedish Agency for Agriculture processes the personal data that you provide in your application for the purposes of permit management, control, statistics, information and for follow-up, evaluation and analysis. The legal basis for processing your personal data is the exercise of authority. The data is processed electronically. The personal data we process about you is shared with other authorities and individuals in accordance with what follows from EU legislation, laws, regulations and international agreements.

The Swedish Agency for Agriculture will store the data in accordance with what applies to authorities' archive management. Contact customer service if you want access to the personal data that we process about you.
